Terms of Use

1. Agreement and eligibility

These Terms form an agreement between you and Hobbiary, the publisher of the app. This agreement is with us alone and not with Apple Inc. or Google LLC; the store you installed from is a distribution channel, not a party. We, not the store operator, are solely responsible for Hobbiary, its content and its support.

By installing or using Hobbiary you accept these Terms and the Privacy Policy. Hobbiary is only for adults aged 18 and over; if you are under 18, you may not install or use it. Consumer rights that cannot be signed away are unaffected.

2. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Hobbiary on devices you own or control, for your own non-commercial use, subject to the usage rules of the store you obtained it from.

You may not sell, rent, sub-licence or redistribute the app, reverse-engineer it except where the law expressly permits, remove proprietary notices, or use it to build a competing product from its internals. Social access may require a Premium entitlement verified by the configured store and server; the applicable price and renewal terms are shown before purchase.

3. What Hobbiary is not

Hobbiary is a personal logbook and nothing more. It does not provide medical, health, fitness, nutritional, financial, legal or other professional advice. Hobby descriptions, starter tips, equipment lists and difficulty indicators are general background written for a broad audience, not an assessment of whether an activity is right for you.

It is not a coach, a trainer or a safety system. It does not evaluate your technique, monitor your condition, warn you about risk, or contact anyone if something goes wrong, and it has no emergency function.

Levels, XP and streaks measure app usage, not competence. They are calculated from what you type in. They certify no skill, knowledge, fitness, qualification or safety, and must never be relied on as evidence that you are ready for an activity. Consult a doctor or a qualified instructor before starting something physically demanding, particularly if you are pregnant, have a medical condition, are returning from injury, or are taking up an activity carrying inherent risk.

4. Your responsibilities

You alone decide which activities to pursue and how. You are responsible for choosing activities appropriate to your health, fitness, skill and circumstances; for obtaining proper instruction, supervision, equipment, permits and insurance; for observing the law where you are; and for stopping when conditions, your body or your judgement say to stop.

Do not use Hobbiary to store unlawful content, another person’s confidential information without their knowledge, or material infringing someone’s privacy or intellectual-property rights, and only attach photographs you have the right to use. Keeping your device secure and locked is your responsibility: anyone who can unlock it can read everything in the app.

5. Your content stays yours

Everything you enter — records, notes, custom hobbies, tracker definitions, photographs — remains yours, and you retain all rights in it.

We take no licence over it and no ownership of it. In local-only use your content remains on your device; if you explicitly migrate to social access, the configured service processes the account copy only to provide migration, sync, rooms, chat, moderation and deletion. We do not use personal tracker content for advertising, profiling or model training.

6. Records, backups and data loss

This section describes the most likely way you could be harmed by using this app. Local-only records are not recoverable by us. If you opt into social access, the account copy is subject to network availability, account access, conflict handling, deletion scheduling and the configured service’s operational limits; it is not a guaranteed backup or archival service.

You can lose local records by losing, breaking, selling or resetting your device, uninstalling the app, using Reset, a device backup that was off or exceeded your platform’s per-app limit, or a storage fault. Exporting remains your responsibility. Export files, weekly snapshots and the social account copy are recovery aids with different scopes, not a promise that every copy will always be present, complete or readable.

7. Availability and changes

We may update, change, suspend or discontinue Hobbiary or its features, and may change the hobby catalog, tracker field types and the backup file format. We try to keep exported files importable and the app validates a file before applying it, but indefinite compatibility across future versions cannot be guaranteed.

If we stop publishing Hobbiary, the copy on your device keeps working for as long as your operating system supports it, since it needs nothing from us to run — but it will receive no updates. Export your data if you want it to outlast the app.

8. Warranty, liability and claims

To the fullest extent permitted by law, Hobbiary is provided “as is” and “as available”, without warranty of any kind. We do not warrant that it will be uninterrupted or error-free, that its calculations or hobby information are accurate or complete, that it is suitable for any particular activity, or that data loss will not occur.

To the fullest extent permitted by law we are not liable for indirect, incidental, special or consequential damages; loss of data, records, photographs or progress; or injury, illness or loss arising from an activity you chose to undertake.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by our negligence, for fraud, or under mandatory consumer-protection law. If you are a consumer, your statutory rights are unaffected.

We, and not the store operator, are responsible for addressing any claim relating to Hobbiary, including product liability, regulatory non-compliance and consumer-protection claims, and for the defence of any third-party intellectual-property claim. We provide any maintenance and support; the store operator has no obligation to do so. You must comply with any applicable third-party terms when using the app, and you confirm you are not located in an embargoed country or listed on a prohibited-party list. Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

9. Law, contact and the full terms

These Terms are governed by the laws of the Republic of Türkiye. If you are a consumer this does not deprive you of the protection of mandatory provisions of the law where you habitually reside. Consumers in Türkiye may apply to the Consumer Arbitration Committees up to the annual monetary thresholds, and otherwise to the Consumer Courts.

We may revise these Terms; a revised version gets a new version number and effective date, and material changes are signposted in the app. Published in English and Turkish: for users in Türkiye the Turkish text prevails, elsewhere the English text prevails.
